Condominio Los Sabinos S.A. de C.V. is incorporated under Mexican law (with all Owners as shareholders) and is regulated by Jalisco Civil Law, our corporate Bylaws, decisions of the Owners Assembly and decisions of the Administrative Council; in that order of hierarchy. Jalisco Civil Law establishes the position and powers of the
- Owners Assembly, which makes decisions on capital expenditures, special fees, the Reserve Fund, Bylaws, annual budgets, membership on the Administrative Council, and the Administrator, as well as other policy within the boundaries set by the Jalisco Civil Code.
- Administrative Council, which supervises the Administrator and makes decisions during the budget year, within the policies/regulations/procedures set by the Owners Assembly, our corporate Bylaws and State Law
- Administrator, who runs the day-to-day operations of the Corporation in collaboration with the Administrative Council, and supervises our employee (Clubhouse cleaner), contracts (security, gardening, pool maintenance, trash collection, accounting), and special projects (common area and services maintenance & repair, mostly).
The corporate Bylaws expand on the powers and duties of the Assembly, the Council and the Administrator, and also establish the procedures and duties of an
- Architecture Committee, which receives proposals from Owners for work to be done on their private units, and makes recommendations to the Administrative Council
Each Owner of a private unit has a % (percentage) share in the corporation as set out in the Jalisco Civil Law, which determines their corporate voting rights and financial obligations. Jalisco Civil Law and the corporate Bylaws also establish the legal Rights and Obligations of each Owner, along with numerous operating regulations.
In addition, the Bylaws provide for further regulations to be determined by the Administrative Council and set out in the Handbook, and the Colour Palette.
