Workers you hire
People you hire to work for you in various roles on a repeating basis will likely be considered employees under Mexican Law and you are required to provide a number of benefits, whether they are full-time or part-time, regular or occasional. For most Residents, this will apply, but is not limited to, maids and gardeners.
Your legal obligations include payments for
- IMSS enrolment
- statuatory holiday premium
- vacation pay
- annual aguinaldo
- severance
You are encouraged to acquaint yourself with these obligations since Mexican workers will usually win grievances they bring against expat employers before a court.
Exceptions: Note that workers that you hire to do a specific, one-off job like paint your casa or fix your water heater are considered contractors, not employees.
